Abstract

Matters of justice and equity in transplantation medicine constitute a very difficult task for the medical profession as well as for philosophers and social scientists. In this context it can be helpful to review the different levels where allocation problems occur, the longstanding discussion on discrimination concerning access to transplantable organs, and the different principles that can be employed for their distribution. An awareness of the current legal regulations as well as their problematic aspects will will contribute to advance the search for the best possible solution, on a general level as well as for each individual patient = Les activités de transplantations d’organes soulèvent des questions difficiles d’équité et justice, non seulement pour les médecins, mais aussi pour les philosophes et pour tous les acteurs sociaux. Dans ce contexte, il pourrait s’avérer utile d’étudier d’une manière plus approfondie les différents niveaux où la distribution a lieu, ainsi comme les risques de discrimination dans l’accès équitable aux organes. Une prise de conscience de ses aspects plus problématiques et de la manière dont les critères de distribution sont repris par la loi, peut contribuer à faire avancer la recherche de règles plus transparentes et équitables pour les individus et la société.
